This Personal Data Protection Policy describes how the Company processes personal data covering your use of our website, as a customer club member, when you contact us and when you shop with us. This Personal Data Protection Policy further describes you rights and how you can exercise your rights against the Company.
You are not obliged to submit any personal data to Micki Leksaker, however, certain activities can not be carried out if you choose not to, such as handling your order.
Micki Leksaker has the right to change this Personal Data Protection Policy at any time. In such event, Micki Leksaker will publish the amended Personal Data Protection Policy on website https://mickiofsweden.com/ and include details about when the amendments will come into force.

2. PERSONAL DATA CONTROLLER

Micki Leksaker AB, org.no. 556063-9022, is the personal data controller for the processing of your personal data, meaning the Company is responsible for ensuring your personal data is processed in a correct and secure manner in accordance with applicable legislation.

3. PERSONAL DATA STORED/PROCESSED AND UNDER WHAT TERMS

Based on Micki Leksaker's policy, we store and process as little of your personal data as possible. The following personal data will be collected from you by Micki Leksaker when you use Micki Leksaker's services.

  • Name
  • Personal identity number
  • Address (delivery and invoice address)
  • E-mail address
  • Phone number
  • Credit card information
  • IP number

The following data may also be collected from you.

  • Marked favourites
  • Website customisations, such as recently viewed products, language selection and currency settings
  • Shopping cart
  • Username and password
  • Order information such as order comments, delivery information, purchased products, how you entered the website and the payment method used.
  • Login information for support cases, such as web browser, headers from the browser, visited pages and products and error messages.
  • Other information submitted by you via e-mail or similar.

(i) When you sign up to become a member

Micki Leksaker may process the following data when you sign up to become a member:
- Name
- Personal identity number (optional)
- Address (delivery and invoice address)
- E-mail address
- Phone number

Your consent is the legal basis for the data collection. You can withdraw you consent at any time by contacting Micki Leksaker. Contact details can be found under section 2 in this policy.

(ii) When you shop with us, return or track a product

  • Name
  • Personal identity number
  • Address (delivery and invoice address)
  • E-mail address
  • Phone number
  • Credit card information (via Klarna)

If your issue regards an order, we will not be able to help you unless you provide the order number. To be able to answer questions and help you further, we will process the personal data you provide when you contact us regarding a complaint or when you track a product. The legal basis for this is our legitimate interest as a business to provide as good customer service as possible to you as a customer, potential customer or for any other purpose.

(iii) When you contact us

You can freely contact us, but you must provide an e-mail address or telephone number if you would like us to contact you further regarding the matter. If your issue regards an order, we will not be able to help you unless you provide the order number. The personal data you provide when you contact us is processed to enable us to answer your questions and help you resolve any issues. If you are a customer, then the legal basis for data collection is to fulfil our contract with you. If you are not a customer, then the legal basis is a balance of the Company's interest to resolve queries and your consent when submitting your personal data to us.

(iv) When you use the website

Technical data may be collected. This includes data generated when you use the website, such as data about your device's operating system and other technical data, the duration of the website visit, when the website was opened most recently, visitor history, information about any excessive response times, etc. The legal basis for processing personal data in this case is a balance test where Micki Leksaker's interest to implement improvements and business decisions based on user behaviour weighs heavier than the user's interest in protecting these details. (v) When you sign up for our newsletter

When you sign up to receive our newsletters, you need to provide an e-mail address so that we can send them. Your consent is the legal basis for the data collection. You can withdraw your consent at any time, either by contacting us directly or by using the link at the bottom of each newsletter.
In some situations, we will disclose your personal data to third parties, such as our IT providers, marketing providers, payment service providers, delivery partners and other partners as described in section 5.

4. STORAGE PERIOD

Micki Leksaker only stores personal data for as long as required to fulfil the purpose for which the data was collected, or for as long as the Company is obliged to store personal data according to applicable law.

(i) When you sign up as a member – Until you close down your account. We erase you account and attached data if your membership has been inactive for 36 months, provided you do not have any unpaid invoices. Inactivity means you have not registered any purchases.

(ii) When you shop with us or cancel a product – Until a purchase has been fully transacted (including delivery and payment) and for 36 months thereafter, for the purpose of managing any cancellation or warranty matters.

(iii) When you track a product – Until you have received a notification that the product is back in stock.

(iv) When you contact us – Personal data are processed until the customer service case is closed and for a period of 36 months thereafter, for the purpose of being able to provide better customer service for future interactions.

(v) When you use the website – Personal data are stored for a maximum of 26 months. Also see section 3 (iv) above and our Cookie Policy.

(vi) When you sign up for the newsletter – Until you close your account or until you have been inactive for 36 months in accordance with (i) above.

In some situations, and in order to protect the Company's legal interests, personal data may be stored longer, for example during an ongoing legal process. Personal data will be erased thereafter.

5. DISCLOSURE AND PROTECTION OF YOUR PERSONAL DATA

In order for you to feel safe and secure when you submit your personal data to us, Micki Leksaker has taken the necessary security measures to protect your personal data against unauthorised access, alteration and deletion.

All personal data is stored on highly secure servers. We further strive to encrypt all personal data where possible.

Micki Leksaker may disclose your personal data to a third party, provided you have given your prior consent, or if there is a legal basis for such disclosure. Micki Leksaker agrees, however, that such disclosure should only be done to a limited extent.

In some cases, we will disclose your personal data to third parties, such as to our IT providers, marketing providers, payment service providers, delivery partners and other partners. Disclosure to payment service providers and delivery partners is done with the purpose of fulfilling the contract we have with you as a customer. We aim to set up personal data processor agreements between us and third parties to ensure personal data is only used for the purposes that we engage such third parties, and only during the time required to fulfil the purpose. We further use your personal data to send targeted ads and marketing to you. We aim to show you only relevant information where possible.

Micki Leksaker always strives to process and store your personal data within the EU/EEA regulatory framework. You should be aware that rules outside the EU/EEA may provide less protection of your personal data.

Should your personal data need to be transferred and stored outside the EU/EEA, Micki Leksaker selects such suppliers with the utmost care with regards to your privacy. Micki Leksaker will also take all necessary security precautions to ensure your personal data is handled securely and with an adequate level of protection (for example by means of approved standard clauses and appropriate security measures).

Micki Leksaker may transfer personal data to the USA. This is done through third party services that we use for marketing purposes.

When personal data is transferred to the USA, we have not control with regards to an adequate level of protection. This means there is a risk your personal data is disclosed to, for example, US authorities as their legislation permits authorities to access your data more freely than the EU. In other words, the protection of personal data in the USA is significantly lower than in the EU. Transfer to the USA is, however, never done without your specific consent each time you visit our website - which you can withdraw at any time.

6. YOUR RIGHTS

Free of charge register extract

As Micki Leksaker is the personal data controller, you have the right to, at any time, receive a free of charge register extract listing the personal data we have stored about you, and further, to obtain information about the purposes of the processing and from where personal data was collected, and to which recipients the personal data has been, or will be, disclosed. You are further entitled to have the register extract include information about the estimated period during which the personal data will be stored or the criteria applied to determine such a period. You also have the right to be informed about any use of automated decision-making (including profiling). Requests to be provided such information shall be made in writing and sent to Micki Leksaker at the address provided above under section ”Personal Data Controller”.

Data portability

You have the right to data portability, i.e. a right to, under certain circumstances, obtain and transfer your personal data in a structured, commonly used and machine-readable format to another personal data controller.

Right to erase

Micki Leksaker will, at your request or on its own initiative, correct, delete identification, supplement or erase personal data that is found to be incorrect, incomplete or misleading. The Company is, in certain situations, obliged to process your personal data even if you have requested the data to be erased - for example in freedom of expression and information cases - in order to fulfil a legal obligation or to perform a task of public interest.

The right to restrict processing

You have, in some situations, the right to demand the processing of your personal data be restricted. Restriction means the personal data is marked so that in the future it can only be processed for certain limited purposes.

Withdrawal of consent

If you previously have provided your consent to processing of your personal data, then you have the right to withdraw such consent.

Automatic decision making

You have the right to object to processing that is solely based on automated decision making (including profiling), when such processing has a legal, or otherwise significant impact you.
